Illinois CDL DUI Lawyer
In order to drive a commercial motor vehicle (CMV), a person needs to have a commercial driver’s license (CDL). These licenses require special training, applications and tests. Additionally the standards for keeping the CDL are higher than a regular driver’s license. Since most people obtain a CDL so that they can work, a violation such as a charge for driving under the influence (DUI) can have a detrimental impact. A CDL license can be put in jeopardy even if the driver is not operating a CMV at the time of the violation. If you need a CDL for work and get arrested for DUI, contact a reputable DUI defense lawyer immediately.

Major Offenses
In Illinois, if you commit a major offense your CDL license will get disqualified for a period of time. This can be a serious difficulty if it is required for your job. These major offenses will get your CDL license disqualified even if you were not operating a CMV at the time of the offense. A major offense while in your personal vehicle during your personal time will affect your CDL license.
Major offenses include:
- Driving under the influence of alcohol or drugs. Blood alcohol content (BAC) of .04 while driving CMV, or BAC of .08 while driving any other vehicle.
- Refusing a breath or blood test.
- Leaving the scene of an accident.
- Using a CMV to commit a felony.
- Causing a death while negligently using a CMV.
- Operating a CMV without a valid CDL.
Disqualification terms for major offenses:
- 1st offense: 1 year, 3 years if transporting hazardous materials.
- 2nd offense: Life. Exception: DUI offenders may be eligible CDL reinstatement after 10 years if they complete approved alcohol treatment program.
Drug and Alcohol Related Offenses
If your regular license is suspended for DUI, then your CDL license will get disqualified even if you were not driving a CMV.
The standards for driving under the influence are stricter when operating a CMV.
Your CDL will be disqualified if:
- You have a BAC of .04 or higher (even if you do not get convicted).
- You refuse testing to determine your BAC.
- You are convicted of DUI.
